Reforms of Ukraine’s Electric Energy Market — Are They the Way to Thriving or to a Catastrophe?

On the 20th of November this year Verkhovna Rada adopted in the first reading the project of the Law of Ukraine “About the principles of functioning of the Ukraine’s electric energy market”. The project of the law was introduced by the people’s deputy I. M. Hlushchenko.

As the authors of the project admit, the main goal of the adoption of this law is liberalization of the Ukrainian Wholesale electric energy market and formation of an effective competing situation at the electric energy market, based on the main demands of the jurisprudence of the EU. Such a goal should be only welcomed. But the actual actions of the government in the electric energy sphere over the last years testify that it is absolutely unprepared for the suggested by the law reforms.

The main point of the reforms is transferring to the bilateral contracts model. It suggests that users may freely choose a deliverer and /or a producer of the electric energy. But what choice can they have, if after the privatization of 2011–2012, 86 % of the electric energy is produced by 2 companies — DTEK and Energoatom?

Price distortions, considerable debts of businesses, nontransparent and corrupted system of state regulation don’t help the reforms to succeed.

But even if the mentioned above problems will be overcome, among the very mechanisms of the market’s functioning, offered by the law’s project, there are such mechanisms which actually level the liberal and competitive advantages of the new model. We mean here the mechanisms of money redistribution at the electric energy market via the Fund of the cost imbalance distribution.

It is clear, that there exists a problem of different costs of the electric energy produced by different types of generation. But the law’s project suggests an absolutely nontransparent way of settling this problem. What volumes of the income of the nuclear and hydro generation businesses will be withdrawn and distributed, and according to what principles it will be done- absolutely not clear. Thus and so, potential opportunities for irregularities and corruption are created.

The presented project of the Law does not increase the level of liberalization of the Ukrainian electric energy market too much, it only makes the system of its regulation even more complicated and expensive.

Adoption of the Law’s project will undoubtedly place a question mark over the future of Ukraine’s nuclear power industry.

First of all this concerns the financial situation of “ Energoatom” and state ownership of its assets.The current price formation system, aiming at keeping the prices of the electric energy for the population socially low,  is fulfilling this task mainly by establishing artificially lowered prices for the nuclear generation. This leads to billions debts of “Energoatom” and makes it a potential bankrupt. It is clear, that in case of the Law ‘s project’s adoption, immediately will arise the question of abrogation of the Law “About the measures for ensuring stable functioning of the enterprises of the fuel-energy complex”, which has imposed a moratorium on bankruptcy of energy enterprises. As the Fund of the cost imbalance distribution most likely will not allow to form a proper tariff for the nuclear power generation, “Energoatom”’s bankruptcy will be just the matter of time.

Secondly, the project of the Law suggests that the current policy of stimulation of the green energy (which in the prospects will be pushing out the nuclear generation from the energy system), should continue.

It is obvious, that introduction of the bilateral contracts market will demand more flexible and transparent mechanisms of the state regulation, which would allow all types of generation to develop normally. The mechanism of investments’ into power security is up to those demands. It is the introduction of this particular mechanism that will allow to create an economically grounded and transparent price creation system at the electric energy market, as well as necessary stimuli for the balanced development of the Ukrainian energy system.
